The purpose of pay equity legislation is to assure workers equal pay for work of
equal value – in particular, to address gender discrimination in the compensation of work done by women.
Why Consider Pay Equity?
If you are a large public institution, or a private business with over 10 employees, that was in existence since the early 90’s, chances are you have a Pay Equity Plan in place. Your robust job evaluation and compensation structure with periodic review, likely maintains your compliance with the law.
If however, you are a new start-up, with over 10 employees, you may not know of your obligation to comply and achieve pay equity in Ontario. The Pay Equity Office is aware of this, and is very active in this regard, sending out letters to small businesses and implementing projects such as the Gender Wage Gap Program to review and report on the status of key priority areas: academia; the private sector and retail.
In its preliminary findings, the Gender Gap Steering Committee stated, “discrimination, based on gender and other social identifiers in the labour market and workplaces, still exists”. For example, in the retail sector it was discovered that Men are being paid more than women in every occupational category. Men outnumber women in the highest paying front-line retail position of ‘Manager’. Retail has few full-time positions, but those that do exist are disproportionately given to men.
It’s safe to say, Pay Equity Legislation is still active and needed!
